TERMS AND CONDITIONS

These Terms and Conditions shall apply to all contracts entered into by JAMIN PUECH (“we or us”) ("SAS LES ABEILLES DILIGENTES” registered in France under n° 395 113 2933 whose office is at 46 rue de Provence 75009 PARIS. By placing your order on our web site www.jamin-puech.com, you are accepting these Terms and Conditions. The company reserves the right to modify these terms and conditions at any time.

1- PRICE

The prices of our products are indicated in euros all inclusive of tax, except share in the expenses of treatment and sending. These prices are communicated in Euros. All the orders whatever their origin are payable in Euros.

2-PRODUCT

At Jamin Puech we are devoted to making things that women can fall in love with. We want you to enjoy this Jamin Puech bag and for it to give you years of pleasure. We take great care to choose only the finest materials for our products but sometimes certain variations of colour and pattern may occur, this is because the bags are hand crafted. The detail of the work involved in each of our pieces requires that you need to treat the product with a lot of care.

You should also follow these general guidelines to keep your Jamin Puech product in good shape:

*For embroidered bag you should be very careful with the beadings and embroideries, they are all handmade. You should take it to a professional dry cleaner to clean it.

* To prolong the life of your leather bag, and minimise the effects of everyday dirt and soiling you should use products designed to protect leather, in carefully following the instructions : Always test any cleaning products on a hidden part of the leather first . Always gently wipe leather, never scrub. Always leave products to dry naturally, never use direct heat. Do not leave products in direct sunlight

Do not overfill bags as they may lose their shape and be damaged

3- ORDER

3-1- Confirmation of order

Your order will be accepted by us by way of a confirmatory e-mail (‘Confirmation of Order’) which will confirm that we are able to send you the goods you have ordered, and the price.  This Confirmation of Order shall contain all of the information regarding the goods you have ordered.  You must immediately check the details contained in the Confirmation of Order and we advise you to print and keep a copy of it.  We reserve the right in our absolute discretion to accept or reject any offer.

3.2 We will aim to dispatch the goods ordered by you as soon as possible after your order has been accepted by us to the postal address you have given in your order.  However, we cannot guarantee an exact delivery date and your goods may take longer to be dispatched if the goods you have ordered are not in stock at the time of placing your order or they are to be dispatched to an address outside of France.

3.3    All products are subject to availability. We will inform you as soon as reasonably possible in the event that the goods you have ordered are unavailable. In the event that the goods that you have ordered are unavailable a full refund will be offered.

3.4    Every care has been taken by us in the preparation of the content of our website, in particular to ensure that prices quoted are accurate at the time of posting the product on the website and that all products are fairly described.  However, your order may not be accepted if there are material errors in the description of the goods you have ordered or their prices.   All prices and offers are subject to change.

3.5   We have aimed to ensure that the colours of our products appearing on our website are as near as possible to the colour of the product. However, the actual colour you see will depend on your computer equipment, and accordingly, we are unable to guarantee the precise colour of the product on delivery.

3.6    Payment

Payments can be made in euros via a credit card. We accept Visa, Mastercard, American Express. Jamin Puech doesn’t keep or store any financial information about its customers on its server or at its office. Jamin Puech has chosen Paybox a leading and secure service provider for the processing of online payments. Jamin Puech may contact you and may require you to provide additional information in order to prevent any act of fraud.

4.  Delivery- shipping

4.1 Destination-Custom duties and taxes

At the moment, we ship to a limited number of countries and this is handled by FEDEX for shipments outside of France and Colissimo within France. Once you have entered your shipping information, the relevant shipping charges and estimated delivery information will be displayed on your order preview. For the USA, Canada, Australia, and all EU countries, the price of goods include all taxes and customs duties, which will be paid directly by us and the relevant paper work will be handled by FEDEX. Deliveries outside of these countries may be subject to import taxes and additional charges for which you will be solely responsible.

4.2 We will aim to dispatch the goods ordered by you as soon as possible after your order has been accepted by us to the postal address you have given in your order.  However, we cannot guarantee an exact delivery date and your goods may take longer to be dispatched if the goods you have ordered are not in stock at the time of placing your order or they are to be dispatched to an address outside of France.

Our service provider will send you an email with the tracking number and the delivery date for your order

For any further information on your delivery, you will have to connect to our service provider’s web site.

We are not responsible for any delay in the delivery due to circumstances beyond our responsibility.

4.3 Please note that because we use carriers to deliver your products, we cannot deliver to PO Box addresses, service not available at weekends.

5.    Returns Policy

5.1-Quality control

All our merchandise is guaranteed to be genuine, in new condition and inspected by the highest quality control to meet the company’s experience standards.

5.2- Return or exchange dates

If you are not satisfied with an item that you have purchased , We will offer a refund or exchange on an unworn, undamaged item within 15 days of it being received by you.

Certain individual products are not ineligible for return, as noted on the website pages displaying those products. Items offered at 50% off or more the original price are final sales.

5.3 Return Merchandise Authorization and conditions

Before returning any product you must obtain a Return Merchandise Authorization (RMA). You obtain your RMA by emailing your request to eboutique@jamin-puech.com. Please indicate in your email the reason why the goods are being returned. All returns goods should be in perfect conditions and must be accompanied by a delivery note (this comes with the delivery of your goods). All item over 100€ is security tagged, the security tag must be intact for the return to be accepted.

We strongly recommend when returning items to us you use recorded or special delivery as we are unable to refund items which are lost in the post.  All goods shall remain your responsibility until we receive them.

5.4 Return address and freight charges

Items purchased on line or via email can’t not be returned to our shops or our retailers.

5.5 Money refund

Only items properly returned under this policy are eligible for a refund. If you choose a refund, the full purchase price (shipping, taxes and customs duties excluded) will be credited to your credit card, when we have received and processed your return, ( typically , within 7-10 business days after we have received the item).

5.6 Exchange

Exchanges are subject to product availability and must be within 15 days of the date of purchase. Exchanged items can only be dispatched after the returned goods have been received and undergone a quality control check and also if the security tag on the item is intact. Return freight charges must be covered by the customer .Please be aware that international customs duties and sales taxes are NOT refunded for shipments outside the European Union (EU).

If you received a damaged or defective item, contact our customer service immediately (within 48 hours from delivery).Please supply your order number from the original confirmation email, your email address and your phone number. We will make every reasonable effort to replace the item in a timely manner. If there is extensive damage to the carton, refuse the order and contact our customer service immediately at eboutique@jamin-puech.com.

5.7  Repairs

Repairs will be accepted and undertaken free of charge for all faulty bags due to a production problem, up to 6 months old.  If your bag needs repairing due to wear and tear or is more than 6 months old repairs will be charged for.  We will of course provide a quotation for approval before any repair.

6. COPYRIGHT

All the bags, texts, comments, works, illustrations and pictures reproduced on the website jamin-puech.com are reserved for the title of the royalty and intellectual document of title, worldwide. Any other use is constitutive of counterfeit and sanctioned with the Intellectual document of title except preliminary authorization of jamin-puech.com . Any reproduction total or partial of the catalogue of jamin-puech.com is strictly prohibited.

7. PRIVACY POLICY

7.1All personal information you supply to us will be treated in accordance with French Data Protection Act dated January 6^th 1978, you have a right of access, of correction and opposition to the personnel data concerning yourself .  The nature of this site means that we will obtain, use and disclose certain information about you (“Data”).  By registering to use the Site you agree to this Use.

7.2 We endeavor to take all reasonable steps to protect your personal Data including the use of encryption technology, but cannot guarantee the security of any Data you disclose online.  You accept the inherent security implications of being and transacting online over the Internet and will not hold us responsible for any breach of security unless we have been negligent.

8. RESPONSIBILITY

The offered products are in conformity with the French legislation into force. It rests with to you to check near the local authorities the possibilities of import or use of the products that your plan to order. Jamin-puech could not be held for person in charge for the inexecution of the contract concluded in the event of unavailability or out-of-stock condition of the product, of cause beyond control, disturbance or all-out strike or partial in particular of the mail service and means of transport and/or communications, flood, fire. Jamin-puech will not incur any responsibility for all consequential damages because of present, trading loss, loss of profit, loss of chance, damage or expenses.

9. APPLICABLE DUTY - COMPLAINT

This contract is subjected to the French law. The language of this contract is the French language. In the event of complaint, the French courts will be only qualified.
